1. Virtual Patent Marking Notice

This page is provided pursuant to the virtual patent marking provisions of the America Invents Act, 35 U.S.C. § 287(a). The following Etched, Inc., a Delaware corporation (“Etched”) products may be protected by one or more of the patents or patent applications listed below. This page may not be all-inclusive; other Etched products not listed here may also be protected by one or more patents. Not all listed patents may be applicable in all jurisdictions. Additional patents may be pending in the United States and elsewhere.

2. Patent List

The following table identifies Etched products and the patents and/or patent applications that may cover them. This list is subject to change without notice as new patents are issued or as product coverage is updated.

Etched products and their associated packaging, documentation, and digital interfaces may reference this page by URL (e.g., etched.com/patents) to satisfy virtual marking requirements under 35 U.S.C. § 287(a). The inclusion of a URL directing to this page on or in connection with a product constitutes constructive notice of the patents identified herein for that product. If you distribute or resell Etched products, you must preserve any patent marking notices, labels, or URLs provided by Etched on or in connection with such products.

Etched endeavors to keep this page current but does not guarantee that the information below is complete or up to date at all times. Patents may be issued, expire, be abandoned, or be reassigned between updates to this page. The date of last modification is noted above. For the most current patent information relating to a specific Etched product, please contact legal@etched.com.

3. Scope and Limitations

The association of a product with a patent number on this page does not constitute a representation that the identified patent covers all features or aspects of the identified product, or that the identified patent is the only patent covering the identified product. Products may be covered by additional patents not listed herein. The absence of a product or patent from this page does not constitute a waiver of any patent rights by Etched. Nothing on this page or in any Etched communication shall be construed as granting, by implication, estoppel, or otherwise, any license or right under any patent or patent application listed herein. Any license to Etched’s patents must be express and in writing signed by an authorized representative of Etched.

4. Enforcement and Rights Reservation

Etched actively monitors and enforces its patent rights. Etched reserves the right to pursue all available legal remedies, including injunctive relief and damages, against any person or entity that infringes, contributes to the infringement of, or induces the infringement of any Etched patent. Neither the posting of this page nor any delay in updating it shall be construed as a limitation on Etched’s right to enforce its patents or recover damages for infringement.

5. Unsolicited Idea Submissions

Etched’s policy is not to accept or consider unsolicited ideas, suggestions, materials, or proposals of any kind (“Unsolicited Submissions”). This policy exists to avoid potential misunderstandings or disputes regarding the origin of ideas, products, or features developed by Etched. If you send Unsolicited Submissions to Etched, notwithstanding any statement to the contrary in your communication:

(a) Etched will have no obligation of confidentiality with respect to the Unsolicited Submissions;

(b) Etched will have no obligation to review, consider, or implement the Unsolicited Submissions;

(c) Etched will be free to use, disclose, distribute, and exploit the Unsolicited Submissions for any purpose, without compensation or attribution to you; and

(d) You hereby assign to Etched all rights (including intellectual property rights), title, and interest in and to the Unsolicited Submissions.
